1. Scope of Services

Aurum.Imports provides:

• Sourcing of new and pre-owned luxury vehicles
• Coordination of inspections and third-party evaluations
• Import, shipping, and logistics facilitation
• Documentation and customs support
• Advisory and brokerage-related services

We act solely as an intermediary and service provider, unless expressly stated otherwise in a written agreement.

2. Consumer Status (EU Law)

If you are acting for personal, non-commercial purposes, you may be considered a consumer under EU law and benefit from mandatory consumer protections.

If you act for business or resale purposes, you are considered a professional client, and certain consumer protections may not apply.

3. Pre-Contractual Information

Before any binding agreement:

• You will receive clear information on pricing, services, and fees
• Any additional costs (taxes, customs duties, shipping) will be disclosed where known
• You acknowledge that vehicle prices and logistics costs may fluctuate
• No contract is concluded until confirmed in writing.

4. Pricing, Payments & Fees

• All prices are stated excluding import duties, VAT, registration taxes, unless explicitly stated otherwise
• Deposits and service fees cover administrative, sourcing, and coordination work
• Service fees are non-refundable once performance has begun, in accordance with Article 16(a) of Directive 2011/83/EU
• Late or failed payments may result in suspension or termination of services.

5. Right of Withdrawal (EU Consumers)

If you are an EU consumer purchasing services at a distance:

• You have a 14-day right of withdrawal, unless
• You expressly request us to begin service immediately and acknowledge that you lose the right of withdrawal once the service has been fully performed
• This acknowledgment may be collected electronically or in writing.

6. Vehicle Condition & Liability Disclaimer

For used or pre-owned vehicles:

• Vehicle condition is based on third-party inspections, seller disclosures, or reports
• We do not guarantee mechanical condition, mileage accuracy, or future performance
• Normal wear, age-related issues, and manufacturer defects are excluded from liability
• Clients are strongly advised to request independent inspections.

7. Delivery, Shipping & Customs

• Delivery timelines are estimates only
• Delays caused by customs authorities, logistics providers, force majeure, or regulatory actions are outside our control
• Compliance with destination-country import laws remains the client's responsibility
• We are not liable for costs or delays caused by third parties or authorities.

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR).

9. Limitation of Liability (EU-Compliant)

Nothing in these Terms limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under EU or national law

Otherwise, our liability is limited to the fees paid for the service in question.

10. Intellectual Property

All website content, branding, logos, and materials are the intellectual property of Aurum.Imports LLC and may not be used without written permission.

11. Suspension & Termination

We may suspend or terminate services if:

• These Terms are breached
• Legal or compliance risks arise
• Required payments are not made

Termination does not affect accrued payment obligations.

12. Force Majeure

We are not liable for failure or delay caused by events beyond reasonable control, including natural disasters, government actions, port closures, strikes, or supply-chain disruptions.

13. Governing Law & Jurisdiction (EU)

These Terms are governed by the laws of the relevant EU Member State.
